Jeff Sessions is the US attorney general – the nation’s top lawyer. You might expect that the nation’s top lawyer would be a… errr … top lawyer. Indeed, republicans cast shade on the legal chops of Obama’s top lawyers, Holder and Lynch (for no reason). They have stoutly defended Sessions.
But there is a problem here. Any lawyer knows that federal judges have certain powers that are conveyed to them as a result of their job. It does not depend on where they sit. Federal judges sitting in New York do not have more power than federal judges sitting in Alaska or Hawaii. Any lawyer also knows that if a judge is asked to do something that he or she is not empowered to do, that becomes an issue to be resolved by that judge, or an appellate judge pronto – before the dirty deed is done. It may be a matter that goes to the U.S. Supreme Court if needed.

So it boggles the mind that this same top lawyer, Jeff Sessions, would say this
“I really am amazed that a judge sitting on an island in the Pacific can issue an order that stops the president of the United States from what appears to be clearly his statutory and constitutional power,” Sessions told “The Mark Levin Show,” a conservative talk show, earlier this week, according to a report by CNN’s Andrew Kaczynski.
Errr … Attorney General Sessions may not realize it, but Hawaii is a state like any other. Its federal judges have the same powers that judges have in any other jurisdiction. In other words, the fact Hawaii is an island in the Pacific is legally irrelevant.
The fact that Sessions is “amazed” that a Hawaiian judge would exercise his powers proves only one thing. Sessions is a moron.
An afterthought – As for the rest of the statement — that President Trump has the power to issue the order in question and is not subject to any judicial review — this issue has been litigated twice and in both cases, judges have said that the argument is nonsense. So stripped to the essentials, Sessions is saying that he is amazed that Trump must obey the law. At least here, Sessions has some lawyerly company. Richard Nixon was a lawyer too and he was also amazed that even though he was president, he had to obey the law. Imagine that!
